CONTRIBUTIONS OF DR. D. B. BORALKAR IN THE FIELD OF TECHNO-LEGAL MATTERS

  1. Expert Comments and Review of technical documents on the subject of Remediation of Hg-Contaminated Soil at Kodaikanal at the instance of Tamil Nadu Pollution Control Board during the years 2015-2018.
  2. Note on issues for compliance regarding hazardous waste management in the matter of Writ Petition (Civil) 657 of 1995, Supreme Court of India, as per hearing dated 22.11.2017, prepared and submitted through the advocate of the Petitioner.
  3. Extract from the Supreme Court Record of Proceedings (24.03.2015):
    “Construction of TSDF/landfills and their continuous monitoring: Reports of the Monitoring Committee, in particular, of Claude Alvares and Dr. Boralkar, to be considered. Not all States/UTs have complied with the recommendations of the Monitoring Committee.”
  4. Report submitted on 30.07.2014 regarding the disposal of 212 containers of hazardous waste lying at JNPT by Dr. Claude Alvares and Dr. D. B. Boralkar – Independent Experts nominated by the Supreme Court. (Order dated 18.02.2014 and subsequent orders in W.P. (C) 657/1995).
  5. Provided techno-legal opinion (19.07.2011) on issues arising out of Hon’ble Jabalpur High Court order directing disposal of M/s UCIL, Bhopal’s hazardous waste at DRDO, Nagpur. Submitted to MPCB.
  6. Extract from the Supreme Court Order (11.10.2011) based on Report of Dr. D. B. Boralkar:
    The Government of India was directed to consider the Report of the Monitoring Committee, the directions contained in the judgment, and to prepare a note on compliance and reasons for non-compliance.
  7. Supreme Court Monitoring Committee: Final Report of Dr. D. B. Boralkar and Dr. Claude, March 2007 submitted in compliance of Order dated 14.10.2003 in W.P. (C) 657/1995.
  8. Final Report of the High Powered Committee (HPC) on Management of Hazardous Wastes, March 2001, chaired by Prof. MGK Menon. Dr. D. B. Boralkar was a Member (Committee constituted by Supreme Court order dated 13.10.1997).
  9. Techno-legal opinion (August 2009) on query: Whether traders are allowed to purchase, import or handle hazardous wastes for recovery/recycling. Query raised by M/s Met Trade India Ltd., Delhi.
  10. Techno-legal opinion (April 2010) on the same subject, query raised by Shri Gopal Krishna, New Delhi.
  11. Member of Indian Delegation (MoEF&CC, Govt. of India) to the United Nations Basel Convention on Transboundary Movement of Hazardous Waste (1997-2003).
  12. Served as Assessing Authority for Maharashtra State under Water (P&CP) Cess Act, 1977 and Member Secretary, Maharashtra Coastal Zone Management Authority under Environment (Protection) Act, 1986 (Quasi-Judicial functions).
